What OTHER Lawyers Won't Tell You

Tough GuyOnly a jury can beat a Ventura County DUI.

There you have it. That’s the secret. Lots of people know that Ventura is “tough” on DUIs, but almost nobody knows what that means. Ventura County is “tough” because the District Attorney refuses to plea bargain DUI cases. That means no deals: you either plead guilty to a DUI or take the case to trial.

If you hire a lawyer who doesn’t take cases to trial, you are going to lose a Ventura County DUI. Period.

That doesn’t mean cops are perfect or that DUI cases have no flaws. Far from it. DUIs are a volume business, subject to all the mistakes that follow a lack of attention to detail. What it does mean is that the prosecutor already knows there are problems with the case and is betting that you’ll hire a lawyer who won’t take the case to trial. A lawyer who tries to negotiate by pointing out the problems with the case will soon find that the prosecutor simply doesn’t care.

How can this be? You’re probably wondering how a prosecutor can ignore major problems with a DUI case, like unreliable breath machines, gastro-esophageal reflux disease or fermentation of a blood sample. The answer, a prosecutor will tell you, is that those problems are issues for a jury, not for plea bargaining.

How can lawyers stay in business if they lose every single case? Again, we wonder the same thing. Our best guess is that they promise to “get the police report” and see if they “can do anything.” What they don’t tell you is that the prosecutor already knows what’s in the police report because he or she reviewed it before filing charges against you.

Why do I need a lawyer to read a police report and plead me guilty? You don’t. So don’t hire one of those.

How can I beat a Ventura DUI? Only by convincing a jury that the many problems with a DUI case cast reasonable doubt
